OVERVIEW

These Terms of Service ("Terms") govern your access to and use of TheBushyBot.com and the services provided through TheBushyBot ("TheBushyBot," "Service," "we," "us," or "our"). By accessing or using TheBushyBot, you agree to be bound by these Terms.

TheBushyBot is a free service that provides a chat bot and related web-based tools for use with Twitch channels. Access to the TheBushyBot dashboard requires authentication through Twitch OAuth. By creating or accessing a TheBushyBot account, you agree that you have read, understood, and accepted these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use TheBushyBot.

These Terms apply to all users of TheBushyBot, including users who access the website, create an account, configure the bot, create custom commands, or otherwise use any portion of the Service.

We may modify these Terms from time to time. The most current version will be made available on this page. Your continued use of TheBushyBot after changes are posted constitutes acceptance of the revised Terms, except where applicable law requires otherwise.

SECTION 1 - THEBUSHYBOT SERVICE

TheBushyBot provides a free chat bot and web-based dashboard that allow users to configure and manage features associated with their Twitch channels.

The TheBushyBot dashboard is accessible only through authentication with Twitch. Certain features, including enabling and configuring TheBushyBot for a Twitch channel, require an authenticated TheBushyBot account.

TheBushyBot is an independent service and is not owned, operated, sponsored, endorsed, or administered by Twitch Interactive, Inc. or Twitch.

Your use of Twitch and any Twitch-related functionality remains subject to Twitch's Terms of Service, Community Guidelines, Developer Agreement, API terms, and other applicable Twitch policies. You are responsible for complying with those requirements while using TheBushyBot.

SECTION 2 - ELIGIBILITY AND USER ACCOUNTS

You must be eligible to use Twitch and comply with all applicable age and account requirements imposed by Twitch and applicable law in order to use TheBushyBot.

Because TheBushyBot uses Twitch OAuth for account authentication, you must maintain an eligible Twitch account in order to access the TheBushyBot dashboard.

Disconnecting or revoking Twitch OAuth access does not automatically delete your TheBushyBot account or the data associated with that account. Your account and associated data remain in accordance with our Privacy Policy unless and until you request deletion or the data is otherwise removed in accordance with our policies or applicable law.

You are responsible for maintaining control of your Twitch account and for all activity performed through your TheBushyBot account.

SECTION 3 - USER-GENERATED CONTENT AND CUSTOM COMMANDS

TheBushyBot allows users to create custom commands and other command content for use with the Service. You retain ownership of the original content you create and submit through TheBushyBot. Nothing in these Terms transfers ownership of your custom command content to TheBushyBot.

By submitting custom commands to TheBushyBot, you grant us the limited permission necessary to store, process, display, transmit, and otherwise use that content solely for the purpose of operating and providing the Service. This includes displaying your commands on pages associated with your account and making them available to the TheBushyBot systems necessary to provide the requested functionality.

Custom commands must comply with these Terms, applicable law, and all applicable Twitch Terms of Service, Community Guidelines, and other Twitch policies.

You may include links, text, and other content in your custom commands provided that the content complies with these requirements. Content that is permitted on Twitch may still be subject to other restrictions under these Terms or applicable law.

You must not create or configure commands that are intended to disrupt, damage, overload, abuse, interfere with, or gain unauthorized access to TheBushyBot, Twitch, or any other service, system, network, or website.

We may remove, disable, modify, or restrict access to custom commands that we reasonably believe violate these Terms, applicable law, Twitch policies, or the operation or security of the Service.

SECTION 4 - PUBLIC COMMAND PAGES

TheBushyBot may provide publicly accessible pages displaying a user's custom commands. By creating custom commands, you acknowledge that the commands may be displayed publicly through these pages as part of the Service.

You are responsible for ensuring that content you place in publicly displayed commands is lawful and complies with these Terms, Twitch's applicable policies, and the rights of others.

You should not place private, confidential, sensitive, or other information that you do not want publicly displayed into a custom command.

SECTION 5 - ACCEPTABLE USE

You agree to use TheBushyBot only for lawful purposes and in accordance with these Terms.

You must not use TheBushyBot to:

(a) violate any applicable law, regulation, or legal requirement;
(b) violate Twitch's Terms of Service, Community Guidelines, Developer Agreement, API requirements, or other applicable Twitch policies;
(c) transmit malware, viruses, malicious code, or other harmful software;
(d) interfere with, disrupt, damage, overload, or impair TheBushyBot or any related system or service;
(e) attempt to gain unauthorized access to accounts, systems, networks, or data;
(f) circumvent security measures, authentication systems, rate limits, or other technical restrictions;
(g) use automated methods to abuse, scrape, attack, or excessively access TheBushyBot without our permission;
(h) use the Service to harass, threaten, defraud, impersonate, or harm others;
(i) intentionally configure commands or other functionality to spam, flood, crash, or otherwise interfere with Twitch, TheBushyBot, or another service; or
(j) use the Service for any purpose that would reasonably be expected to cause harm to TheBushyBot, Twitch, another user, or another service.

We reserve the right to restrict, suspend, or terminate access to TheBushyBot when we determine that a user has violated these requirements or poses a risk to the Service, its users, or third parties.

SECTION 6 - TWITCH REQUIREMENTS

TheBushyBot integrates with Twitch and relies on Twitch authentication and related Twitch functionality. Your use of TheBushyBot therefore requires compliance with Twitch's applicable rules and policies.

You are responsible for ensuring that your use of TheBushyBot in connection with your Twitch channel complies with Twitch's Terms of Service, Community Guidelines, Developer Agreement, API policies, and any other rules applicable to your Twitch account or activity.

TheBushyBot does not guarantee that any configuration, command, or use of the Service will be permitted by Twitch. Twitch may independently restrict, suspend, terminate, or otherwise take action against your Twitch account or channel.

TheBushyBot is not responsible for actions taken by Twitch against your account, channel, content, or use of Twitch services.

SECTION 7 - SERVICE AVAILABILITY AND MODIFICATIONS

TheBushyBot is provided as a free service and is currently offered without subscription fees, usage fees, or other charges to users.

We do not guarantee that TheBushyBot will always be available, uninterrupted, timely, secure, or error-free. The Service may become unavailable due to maintenance, updates, technical problems, third-party service interruptions, network issues, security incidents, or other circumstances.

We may modify, suspend, restrict, or discontinue any portion of TheBushyBot at any time, including individual features or functionality. We are not required to provide advance notice of such changes.

We do not guarantee that any particular feature will remain available or that TheBushyBot will continue to be offered indefinitely.

SECTION 8 - THIRD-PARTY SERVICES

TheBushyBot relies on third-party services to provide portions of its functionality, including Twitch for authentication and Twitch-related functionality and third-party infrastructure or content delivery services used to operate the website.

Your use of third-party services is subject to the applicable terms, policies, and requirements of those providers. We do not control third-party services and are not responsible for their availability, functionality, policies, actions, or failures.

The use of third-party services does not create a partnership, joint venture, endorsement, or agency relationship between TheBushyBot and those providers unless expressly stated otherwise.

SECTION 9 - THIRD-PARTY LINKS

The Service may contain links to websites, services, or resources operated by third parties. These links are provided for convenience and do not constitute an endorsement or guarantee of the third party or its services.

We do not control third-party websites or services and are not responsible for their content, availability, security, privacy practices, or terms. Your use of third-party websites and services is at your own risk and is subject to the terms and policies of those third parties.

SECTION 10 - INTELLECTUAL PROPERTY

TheBushyBot and its associated website, software, source code, design, user interface, branding, logos, graphics, documentation, original content, and other materials provided by TheBushyBot are owned by or licensed to TheBushyBot and are protected by applicable intellectual property laws.

Except as expressly permitted by us or applicable law, you may not copy, reproduce, distribute, modify, publish, sell, sublicense, reverse engineer, exploit, or create derivative works from TheBushyBot or its proprietary materials.

Your use of TheBushyBot does not grant you ownership of any TheBushyBot intellectual property.

You retain ownership of original custom command content that you create and submit to the Service, subject to the limited rights granted to TheBushyBot under these Terms to operate and provide the Service.

SECTION 11 - PERSONAL INFORMATION

Information collected and processed in connection with your use of TheBushyBot is governed by our Privacy Policy.

By using TheBushyBot, you acknowledge that you have reviewed our Privacy Policy and understand how information associated with your account and use of the Service is handled.

SECTION 12 - DISCLAIMER OF WARRANTIES

TheBushyBot is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by applicable law.

We do not guarantee that the Service will be uninterrupted, secure, timely, accurate, reliable, complete, available, or free from errors, defects, vulnerabilities, or harmful components.

We do not guarantee that TheBushyBot will meet your particular requirements or that any results obtained from using the Service will be accurate, reliable, or suitable for your purposes.

We are not responsible for interruptions, failures, delays, errors, or other issues caused by Twitch, hosting providers, content delivery networks, internet service providers, network failures, or other third-party services or circumstances outside our reasonable control.

To the fullest extent permitted by applicable law, we disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and warranties arising from course of dealing or usage of trade.

SECTION 13 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, TheBushyBot.com and its owners, operators, affiliates, contractors, service providers, licensors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunities, goodwill, data, or other intangible losses arising out of or relating to your use of, or inability to use, TheBushyBot.

This includes, without limitation, losses or damages resulting from service interruptions, bot errors, command failures, Twitch actions, account restrictions, channel restrictions, data loss, unauthorized access, third-party service failures, or reliance on information or functionality provided by TheBushyBot.

To the fullest extent permitted by applicable law, you use TheBushyBot at your own risk.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

SECTION 14 - INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TheBushyBot.com and its owners, operators, affiliates, contractors, service providers, licensors, and agents from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

(a) your violation of these Terms;
(b) your violation of applicable law or third-party rights;
(c) your custom commands or other content submitted to the Service;
(d) your misuse of TheBushyBot; or
(e) your violation of Twitch's Terms of Service, Community Guidelines, or other applicable Twitch policies.

SECTION 15 - ACCOUNT SUSPENSION AND TERMINATION

We may suspend, restrict, or permanently terminate your access to TheBushyBot at any time if we determine that you have violated these Terms, applicable law, Twitch requirements, or otherwise misused the Service.

Grounds for suspension or termination may include, but are not limited to, abuse of the Service, malicious activity, attempts to interfere with or compromise the Service, unauthorized access attempts, abuse of integrations or APIs, violation of security or rate limits, unlawful activity, harmful or disruptive commands, or violations of Twitch's applicable rules.

For serious violations or situations where immediate action is reasonably necessary to protect TheBushyBot, its users, Twitch, or another service, we may suspend or terminate an account without prior notice.

We may also terminate or restrict access to the Service for other legitimate operational, security, or business reasons.

Termination of your access does not automatically delete your account or associated data. Account deletion may be requested in accordance with our Privacy Policy.

Provisions of these Terms that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will survive termination.

SECTION 16 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law, and the remaining provisions will remain in full force and effect.

SECTION 17 - NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future. Any waiver must be expressly made by us to be effective.

SECTION 18 - ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies expressly incorporated into these Terms, constitute the entire agreement between you and TheBushyBot concerning your use of the Service and supersede prior agreements or understandings concerning the same subject matter.

If there is a conflict between these Terms and a specific policy governing a particular feature of the Service, the specific policy will control only to the extent necessary to resolve that conflict.

SECTION 19 - GOVERNING LAW AND DISPUTES

These Terms and your use of TheBushyBot will be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or your use of TheBushyBot shall be brought in the state or federal courts located in Ohio, and you consent to the jurisdiction of those courts.

Nothing in this section is intended to prevent a user from exercising rights or pursuing claims that cannot legally be waived or restricted under applicable law.

SECTION 20 - CHANGES TO THESE TERMS

We may update, modify, or replace these Terms at any time. The updated version will be posted on this page with the revised effective date or other appropriate indication of the change.

It is your responsibility to periodically review these Terms for changes. Your continued access to or use of TheBushyBot after revised Terms are posted constitutes acceptance of the revised Terms, except where applicable law requires a different form of acceptance.
